Acceptance of Terms

By accessing or using MailSequence ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the modified terms.

Account Requirements

Eligibility

You must be at least 18 years old and have the authority to enter into this agreement on behalf of your organization.

Account Security

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorized access or security breach.

Account Information

You agree to provide accurate, current, and complete information during registration and to update it as needed.

Acceptable Use Policy

You agree to use MailSequence only for lawful purposes and in compliance with our Anti-Spam Policy. You may not:

• Send unsolicited commercial emails (spam)
• Use purchased, rented, or scraped email lists without proper consent
• Send emails containing malware, phishing attempts, or fraudulent content
• Impersonate others or misrepresent your identity
• Violate CAN-SPAM, GDPR, or other applicable email regulations
• Use the Service to harm, harass, or threaten others
• Attempt to bypass rate limits, security measures, or access restrictions
• Interfere with or disrupt the Service or its infrastructure

Violation of these terms may result in immediate account suspension or termination without refund.

Service Availability

Uptime

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control.

Service Changes

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

Data Retention

We retain your data while your account is active and for a reasonable period afterward. You are responsible for exporting any data you wish to keep before canceling your account.

Payment Terms

Billing

Paid plans are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all fees incurred.

Refunds

We do not provide refunds for partial months or unused portions of annual plans, except as required by law or at our sole discretion.

Price Changes

We may change our pricing with at least 30 days' notice. Price changes do not apply to current billing cycles.

Payment Failure

If payment fails, we may suspend or terminate your account after reasonable attempts to collect payment.

Intellectual Property

Your Content

You retain ownership of all content you upload to the Service (email copy, contact lists, etc.). You grant us a limited license to process and store your content solely to provide the Service.

Our IP

MailSequence and all related trademarks, logos, software, and documentation are our property or our licensors'. You may not copy, modify, or create derivative works without our permission.

Termination

By You

You may cancel your account at any time through your account settings or by contacting support.

By Us

We may suspend or terminate your account immediately if you violate these terms, particularly the Acceptable Use Policy, or if required by law.

Effect of Termination

Upon termination, your access to the Service will end immediately. We may delete your data after a reasonable retention period.

Disclaimers and Limitations

Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE SPECIFIC DELIVERABILITY RATES OR INBOX PLACEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Deliverability

While we provide tools to improve email deliverability, we cannot guarantee that your emails will reach the inbox. Deliverability depends on many factors outside our control, including your domain reputation, email content, and recipient behavior.
